We respect the work of artists and creators, and we expect everyone on Roomy to do the same. If something on Roomy uses your work without permission, tell us and we will act.
We follow the notice and counter-notice process of the US Digital Millennium Copyright Act (DMCA).
Our designated agent
Send copyright notices and counter-notices to our designated agent:
Email is the fastest way to reach us, and it is how we answer. Our postal address and phone number for notices are in our entry in the US Copyright Office's DMCA Designated Agent Directory, and we add them to this page when the entry is published. Until then, a notice sent by email to copyright@roo.my reaches the agent.
Sending a notice
Your notice must include:
- Your physical or electronic signature. A typed full name is an electronic signature.
- The work you say is being infringed. If there are several, a list of them.
- What on Roomy infringes it, and where: the room's address (roo.my/@name) and which picture, link, video or song.
- Your name, postal address, phone number and email address.
- This statement: "I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."
- This statement: "The information in this notice is accurate, and under penalty of perjury, I am the owner, or am authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed."
If you knowingly misrepresent that something infringes, you can be liable for damages. Please check first, and think about whether the use might be allowed, for example as fair use.
What we do with a notice
- We check it has everything above. If something is missing, we may ask you for it.
- We take the picture, link, video or song down quickly. A picture we take down is kept out of sight, not deleted, so it can be put back if the notice is countered.
- We tell the room's owner what we took down, in the editor and by email if their account has an email address. If they ask, we tell them it was a copyright notice and send them a copy of it, with your contact details removed.
Counter-notice: if your content was removed
If you believe we removed something by mistake, or because it was misidentified, you can send a counter-notice to our designated agent. It must include:
- Your physical or electronic signature.
- What was removed, and where it was: the room's address and which picture, link, video or song.
- This statement: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled."
- Your name, postal address and phone number.
- This statement: "I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located or, if my address is outside the United States, for any judicial district in which Quartz Apps LLC may be found, and I will accept service of process from the person who provided the original notice or that person's agent."
Please note: we send your counter-notice, including your name and address, to the person who sent the original notice.
When we receive a valid counter-notice, we send it to the person who sent the notice, and tell them we will put the material back in 10 business days. We put it back between 10 and 14 business days after we received the counter-notice, unless they first tell us they have gone to court to stop it.
If you knowingly misrepresent that something was removed by mistake, you can be liable for damages.
Repeat infringers
We close the accounts of people who repeatedly infringe copyright. An account is closed when it has had 3 valid notices in 12 months, not counting notices that were withdrawn or successfully countered. We may close an account sooner when the infringement is deliberate or serious. Someone whose account we closed may not make a new one.
The free pictures
The free pictures any room can hang are public domain works and photographs given to the public domain. Their sources and licences are listed under Picture credits in the Terms.
